A Federal judge stuck down all components of the Biden administration’s FLSA overtime rule. Baylor will not proceed with any exemption changes for January 2025.
The Fair Labor Standards Act (FLSA) is a federal law administered by the United States Department of Labor (DOL) that, amongst other things, establishes minimum wage and overtime pay regulations for employees. Baylor proudly acknowledges its nation-wide workforce and remains committed in continuing to adhere to both federal and state regulations by ensuring proper employee classification.
The Fair Labor Standards Act (FLSA) is a federal regulation that:
- Establishes the criteria for a job to be exempt (salary/monthly) or non-exempt (hourly/biweekly)
- Establishes the federal minimum wage required for all non-exempt (hourly/biweekly) jobs
- Guarantees overtime at a rate of one and a half times (1.5x) the employee's regular hourly wage for all hours worked in excess of 40 in a given workweek (Baylor’s workweek begins Sunday and ends the following Saturday)
- Governs the employment of minors
On November 15, 2024, a Federal judge in the U.S. District Court for the Eastern District of Texas struck down all components of the Biden administration’s FLSA overtime rule.
This nationwide ruling has led to the following changes:
- The scheduled salary threshold increase of $58,656 annually ($1,128/week), which was set to take effect on January 1, 2025, has been eliminated.
- The July 1, 2024, salary threshold increase of $43,888 annually ($844/week), has been reverted to the previous threshold of $35,568 annually ($684/week).
- The automatic threshold increases planned to occur every three years have been eliminated.
Following the recent court ruling, Baylor will not proceed with any exemption changes for January 2025.
