Pregnant Workers Fairness Act (PWFA) Now in Effect
In June 2024, new provisions for the Pregnant Workers Fairness Act (PWFA) came into effect and expanded protections for expecting and new mothers. As a Baylor employee, there are a few key aspects of these new guidelines that are important to note.
- The PWFA applies to all employees experiencing pregnancy or a pregnancy related condition. A pregnancy related condition includes concerns such as morning sickness, high blood pressure, migraines, lactation, and post-partum depression.
- The PWFA provides accommodations to help pregnant employees complete the essential functions of their job and maintain an equitable working environment. An accommodation is any change to the essential functions of the job or the manner in which the job is completed. Examples of reasonable pregnancy accommodations may include frequent breaks to eat, drink, and use the restroom; time off for healthcare appointments and recovery; ability to stand if the work requires sitting and sit if the work requires standing; and remote work. HR works with the employee and their department to determine reasonable accommodations based on individual needs.
- When an employee would like to request an accommodation related to pregnancy, they can reach out directly to HR or speak to their supervisor. There is not specific documentation needed to request an accommodation. HR can help employees determine what accommodations may best meet their needs.
- When a pregnant employee discloses their pregnancy to their supervisor, it is the supervisor’s responsibility to notify Human Resources. When HR is notified of a possible need for accommodation related to pregnancy, an HR representative will reach out directly to the employee to learn more about their specific needs.
